Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Reinforx Bartlett Concrete, concerning your access to and use of our services. You agree that by accessing our services, you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using our services and you must discontinue use immediately.

Services Description

Reinforx Bartlett Concrete provides professional concrete installation, repair, and related services for residential and commercial properties. Our services include but are not limited to concrete driveways, patios, walkways, foundations, stamped concrete, and commercial flatwork. All services are subject to availability and may be modified or discontinued at any time without notice.

Quotes and Estimates

All quotes and estimates provided are valid for 30 days from the date of issue unless otherwise specified. Quotes are based on information provided by the customer and site conditions as observed at the time of estimate. Final pricing may vary if actual conditions differ from those initially assessed. We reserve the right to adjust pricing if unforeseen circumstances arise during project execution.

Payment Terms

Payment terms will be specified in your project contract or agreement. Typical payment schedules include a deposit upon contract signing, progress payments during project execution, and final payment upon completion. We accept various payment methods including cash, check, and credit cards. Late payments may be subject to interest charges as permitted by law. We reserve the right to suspend work or place liens on property for non-payment.

Project Scheduling and Delays

We make every effort to complete projects according to agreed schedules. However, project timelines may be affected by weather conditions, material availability, permit delays, or other circumstances beyond our control. We will communicate any delays promptly and work to minimize their impact. We are not liable for damages resulting from delays caused by circumstances beyond our reasonable control.

Warranties and Guarantees

We stand behind the quality of our workmanship and materials. Specific warranty terms will be provided in your project contract. Warranties typically cover defects in materials and workmanship for a specified period. Warranties do not cover damage caused by improper use, lack of maintenance, acts of nature, or modifications made by others. To maintain warranty coverage, customers must follow recommended maintenance procedures.

Customer Responsibilities

Customers are responsible for providing accurate information about project requirements and site conditions. Customers must ensure clear access to work areas and remove any obstacles that may interfere with work. Customers are responsible for obtaining any necessary approvals from homeowners associations or other governing bodies. Customers must secure pets and ensure the safety of children during work operations.

Limitation of Liability

To the fullest extent permitted by law, Reinforx Bartlett Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services. Our total liability for any claim shall not exceed the amount paid by the customer for the specific services giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

Dispute Resolution

Any disputes arising from these Terms of Service or our services shall first be addressed through good faith negotiation between the parties. If negotiation fails to resolve the dispute, the parties agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Shelby County, Tennessee. The prevailing party in any dispute shall be entitled to recover reasonable attorney fees and costs.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms of Service shall be brought exclusively in the courts of Shelby County, Tennessee.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these Terms of Service periodically.
